DAS is a statutory debt management tool introduced by the Scottish Government to help people in debt repay their creditors. Debtors who are habitually resident in Scotland can apply for a debt payment programme(DPP) under DAS. Therefore, if you are a creditor based in Scotland or elsewhere in the UK, or even abroad, you can be a party in a DPP which means that you must comply with the DAS legislation if your debtor’s DPP is approved. Under DAS, a debtor can apply for a DPP which allows them to repay their debts based on their disposable income. A programme can last for any reasonable length of time subject to the value of the debt. The DPP proposal will be sent to you for your approval. If the DPP is approved you will receive regular payments towards the debt(s) owed to you under terms agreed in the DPP. When the DPP is approved you must freeze all interest, fees, penalties or other charges owed by the debtor on the debt included in the DPP. If the DPP is completed you must write off all the interest, fees, penalties or other charges. Whilst the debtor is participating in an approved DPP you cannot take any form of enforcement action to recover debts
